A Caffe Nero employee feared she was going to die when Gary Maddison, 65, told her and a colleague “this is going to be your last breath,” said Rob Galley, prosecuting.
The 65-year-old was brandishing a small silver pistol at them outside their café in Davygate shortly after midday in front of shoppers and customers, York Crown Court heard.
He pulled the trigger, but the gun was a toy gun and didn’t have any bullets in it.
The woman barista was so terrified by the incident she has since changed jobs and made other alterations to her life to avoid encountering Maddison again, said Mr Galley.
Maddison, of no fixed address, pleaded guilty to possessing an imitation firearm with intent to cause others to fear violence. Two charges of threats to kill were left on file so they are part of his criminal record but are not convictions.
